  3. Assault in the 3rd degree is a class C felony. It involves assault against a law enforcement officer, peace officer, nurse, physician, judicial officer, court-related employee, firefighter, transit operator, school bus driver, or anyone acting in a professional capacity.
  4. Assault in the 4th degree, commonly called “simple” assault, is considered a gross misdemeanor. This is the most common assault charge in Washington state.
